1. How We Work

1. We operate the Website as an electronic marketplace platform, and we allow you to make orders to pay for products through the Website and have the product(s) delivered to the address you specify.

2. We only select retailers whose products meet our values and commitments and allows them to offer their products for sale directly on the Website.

3. The Contract is between you and the relevant Retailer, not us. You are buying the products from the retailer, not us. However, we are authorised to act as the agent of our Retailers to conclude and enter into the Contract with you. We are simply the intermediary marketing and promotions platform which facilitates your making Orders with Retailers and your payment for that Order.

4. In our agreements with them, we require Retailers to ensure the Products they make available comply with applicable UK laws and regulations.

 

 

2. Terms of Sale

1. By placing an order on www.bystories.com, you agree with the terms and conditions on this website.

2. In order to shop on this Website, you must be at least 18 years old and possess a valid credit or debit card issued by a bank acceptable to us. You must also have a residential address to make an order. We retain the right to refuse any request made by you.

3. After you place an Order, you will receive an email from us acknowledging that we have received it, but please note that this does not mean that your Order has been accepted.

4. The Contract is formed when we send you an Order confirmation email to the email address that you used to checkout your order.

5. If for any reason we are unable to accept or fulfil your order, we will let you know via email as soon as we can.

6. A Product will be your responsibility from the time the Product is delivered to the address you provided when you submitted your order.

3. Use of Our Website

1. We reserve the right to withdraw any items from this Website at any time and/or remove or edit any materials or content on this Website.

2. Whilst we will use our reasonable endeavours to process all the orders submitted to us, there may be exceptional circumstances which mean that we may need to refuse to process or accept an order after we have received it or sent you an Order Confirmation, which we reserve the right to do at any time.

3. Access to this Website is permitted on a temporary basis. We reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period.

4. We will not be liable to you or any other third party by reason of our withdrawing any item from this Website, removing or editing any materials or content on this Website or for refusing to process or accept an order after we have received it or sent you an order confirmation.

The images of the Products on our Website are for illustrative purposes only. Although we try our best to accurately display the attributes of our products, including composition and colours. The colours you see will depend on your computer system or mobile device, and we cannot guarantee that your screen will display accurately the colours of our products.

6. Price of Products

1. The prices of the Products will be as quoted on our Website at the time you submit your Order. 

2. Prices for our Products may change from time to time, but changes will not affect any Order you have already placed.

3. The price of the Products does not include delivery charges.

You can use any of the following payment methods to pay for your order: Apple Pay, PayPal, Credit/Debit cards.

8. Delivery

1. Retailers will try their best to dispatch the orders within 3 working days after the order is approved.

2. Shipping times may vary depending on where the order is to be delivered. We and the Retailers are not liable for any occasional delays that may occur during peak periods or in the case of unexpected events.

3. If your order could not be delivered for reasons not attributable to us or the Retailers, your order will be returned to the Retailer and subsequently we will terminate the contract (ie. Your order will be cancelled). As a result, we will return to you all payments received from you excluding the delivery fee charged for and a 10GBP processing fee will be deducted from the refund.

​10. Manufacturer's Guarantee​

Some of the Products we sell to you come with a manufacturer's guarantee. For details of the applicable terms and conditions, please refer to the manufacturer's guarantee provided with the Products.

We will not be liable for any loss you suffer nor liable to you for any damages as a result of the unavailability of such Product(s), to the fullest extent permitted by law.

1. We are not responsible for any loss or damage that is not foreseeable including any loss or damage that is not a foreseeable result of our breaching these Terms or failing to act with reasonable care and skill.

2. We are not liable for business losses. We only supply the Products for to you for domestic and private use.

3. We are not responsible for ensuring that the Products are suitable for your purposes.

2. Without limiting any of our other rights, we may suspend the supply or delivery of the Products to you, or terminate the Contract with immediate effect by giving written notice to you.​

These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.
